You Can Say "NO"
If they don’t have a court Order, and haven’t taken possession, you can tell them to stop. They must obey.
You Could Have a Case
If the repossessor does any of the following, then you may have a worthwhile case to pursue against the reposessor and the bank:
- Insults or disrespects you in any way
- Physically touches you in any unwelcome way
- Refuses to stop the repossession upon request
- Refuses to leave your property
- Enters your property against your instructions
- Enters any enclosed area of your property without express permission
- Enters any dwelling without express permission
- Threatens you physically
- Threatens to call the police
- Calls the police
- Damages your property
- Damages your vehicle
- Misrepresents anything, like having a court Order
- Discloses any personal information to your neighbors, like they are trying to collect a debt or repossess your car
